Statutory Warranty
If a product is found to have a defect, the consumer has the right to request the seller to eliminate the defect (replace the product, reduce the price) or to withdraw from the contract. Product replacement is the consumer’s primary right, meaning that the consumer must first request a replacement, unless this is impossible due to the nature of the product or would require disproportionate or excessively high costs.
When determining whether the cost is disproportionate or excessively high, the following must be considered:
a) The price of the product or service if it were in conformity with the contract;
b) The degree of non-conformity of the product or service;
c) The possibility of eliminating the defect without causing inconvenience to the consumer.
The product must be replaced within a reasonable time, in a way that does not cause significant inconvenience for the consumer, taking into account the nature of the product and the purpose for which it was purchased.
The consumer has the right to request the repair or replacement/return of a defective product within 2 years from the date they received the product. If the consumer discovers a defect within 6 months of receiving the product, it is presumed—unless proven otherwise—that the defect existed at the time of delivery, provided this is compatible with the nature of the product or type of defect. In this case, the burden of proof lies with the seller. If the defect is discovered after 6 months, the burden of proving that the defect existed at the time of delivery lies with the consumer.
Attention Consumers!
The consumer has the right to request a price reduction or terminate the contract if any of the following conditions apply:
Product replacement is impossible if:
• The consumer does not wish to exchange the product for any other product of equal or higher value (the consumer pays any price difference);
• The seller does not replace the product within a reasonable time and the consumer loses interest in fulfilling the contract;
• Replacement by the seller would cause significant inconvenience to the consumer.
Upon withdrawal from the contract, the consumer has the right to claim compensation for damages caused by non-performance of the contract, in accordance with Georgian law. The consumer does not have the right to withdraw from the contract if the defect is minor.
The seller is obliged to refund the full amount to the consumer’s bank account within no more than 5 working days after the request is submitted. The statutory warranty does not apply to entrepreneurs/legal entities.
Please Note:
• The store must be contacted by the person who made the purchase, presenting an ID and any document confirming payment.
• The consumer must request a return/exchange at the branch where the product was purchased.
• The refund will be transferred to the bank account of the person in whose name the purchase was made, unless an additional agreement is made between the company and the consumer.
• The consumer will receive the exact amount paid at the time of purchase.
• Gifts, vouchers, or other items received during purchase must be returned together with the product; otherwise, their value will be deducted from the refund. The value of gifts is considered to be their current price within the seller’s network.
A product cannot be exchanged/returned if:
The packaging is damaged, or the protective seal or label has been removed.
